Action for death by wrongful act in the Hennepin County District Court brought by Margaret Lindbery as trustee for the next of kin of Robert Edward Lindbery who allegedly died as the result of being struck by a truck owned by defendant J. A. Danens & Son, Inc., and operated by defendant Edward McMahon. The case was tried before Irving R. Brand, Judge, and a jury. On the basis of a special verdict finding that negligence on the part of McMahon was the proximate cause of the accident and that damages amounted to $25,000, the court ordered judgment in that amount against McMahon. It ordered judgment in favor of the other defendant. Plaintiff appealed from the judgment entered.
